Who we are and how to contact us

Al Tannaf is an animal feed retail business specialising in providing high-quality forage, grains, and feed commodity (“Al Tannaf”), and uses its website and mobile application as online platforms to facilitate sales and distribution of products and services to its customers (“Services”).

Al Tannaf and the Services are owned and operated by Al Dahra Agriculture SP LLC, a limited liability company registered in Abu Dhabi, UAE (“we”, “us” or “our”).

By using any of our Services, you confirm that you accept these terms, and you agree to comply with them.

These terms refer to the following additional terms, which also apply to your use of our Services:

By accessing or using our Services, you are representing that you have read, understood, and agreed to be bound by all the applicable terms, and to the collection and use of your information by us as set out in our Privacy Policy.

Our Services are provided strictly in accordance with these terms, and they will apply to all orders/delivery requests placed by you. Our terms are subject to your statutory rights under consumer laws in the UAE, and we are committed to fully abide by them.

If you do not agree to these terms, you must not use our Services.

General

We amend these terms from time to time. Every time you wish to use our Services, please check these terms to ensure you understand the terms that apply at that time.

We may update and change our Services from time to time to reflect changes to our products, our users' needs and our business priorities.

We do not guarantee that our Services, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Services at any time without notice or liability unless otherwise expressly set out in these terms.

You are also responsible for ensuring that all persons who access our Services through your internet connection are aware of these terms and other applicable terms and conditions, and that they comply with them.

You acknowledge that we will NOT deal or provide any Services or products to any OFAC (Office of Foreign Assets Control) sanctioned countries in accordance with the laws of UAE or similar regulations issued by any authority where we make our Services available.

You must be an individual of at least 18 years of age or above to use and have access to our Services. Minors are prohibited to register or create an account and are not allowed to transact or use the Services.

We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights, if any.

Registration, Account, Password & Security

Certain features of our Services may require you to register and create an account, including setting up a username and password. We may decline a registration request at our sole discretion. Your action of registration constitutes your confirmation of acceptance of these terms, and you agree that:

  • the personal information that you are required to provide to create an account and place orders is true, complete and accurate in all respects.

  • you will notify us immediately of any changes to the personal information by updating your details on “Personal Details” when you are logged in on the Service;

  • you will not impersonate any other person or entity or to use a false name or a name that you are not authorised to use;

  • you will not take any action that imposes unreasonable or disproportionately large burden on our infrastructure;

  • you will be entirely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account as result of your failure to keep this information secure and confidential.

  • you will notify us immediately of any unauthorized use of our account or password, or any other breach of security;

  • you will not use anyone else’s username, password or account at any time without the express permission and consent of the holder of that username, password or account.

We cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

Personal information that we collect from you is treated as confidential. We will keep it on a secure server and fully comply with all applicable privacy and consumer legislation. Order Placement

You will be guided throughout the process when using our Services. By pressing the checkout button at the end of the checkout process an order will be placed and we will acknowledge the same within the platform’s interface and by sending an email detailing the products selected. You will also be able to schedule the order delivery for a selected time, date, week, or month as per our availability.

The range and prices of our Services may differ depending on the delivery location or volume. You might be contacted to confirm your order if the total item in an order exceeds normal order volumes or if we need to clarify any other information provided by you. You may not be able to alter or add items to the order once it has been acknowledged on our platform.

We reserve our right to decline any order for any reason, including but not limited to unavailability of stock, or inability to obtain authorisation for your payment, or if a price or product description error is identified.

Order Acceptance

Order acceptance and the formation of the contract between you and us will take place upon the dispatch to you of the products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with our Cancellation, Return and Refund Policy.

Delivery

Delivery is available in selected areas. At the point at which you place your order, you will provide your address and you will have the opportunity to select a date and time slot for delivery.

Orders will be delivered directly to the delivery address specified by you when placing the order, or to any such other location as agreed by us with you when accepting your order. Deliveries are performed either by a delivery partner, or by Al Tannaf’s delivery team, depending on the nature or volume of the goods and/or the delivery location. You will be responsible for all arrangements required to enable you to take over the goods being delivered, including any preparations at your premises, warehouses, and/or or chosen place of delivery. We will not be responsible for products left unattended once we have delivered them at the place of delivery.

You must check each product carefully at the time of delivery and before you take the products. Should you not be satisfied with a product, you can reject it at the point of delivery or proceed as set out in our Cancellation, Return and Refund Policy. If you have not contacted us within 24 hours of delivering your order, we will deem that you are satisfied with and have accepted our products and Services.

Payment Conditions

All our prices shown are inclusive of 5% VAT when applicable.You can pay online by credit or debit card online.If you make a payment online using our Services, the details you are asked to submit will be provided directly to our payment gateway provider via a secured connection. You warrant the accuracy of the details provided to us. You must retain a copy of the transaction records together with a copy of all our applicable policies and terms.

Special Disclaimers

We take care to update the products information displayed on the Services regularly. Images are provided to help recognize products; due to packaging redesign and improvements these may not reflect exactly the pack you receive. In rare cases, the information may deviate from the details printed on the product packaging. In such an instance, the information on the packaging takes precedence. Because product ingredients may change at any time, we recommend that you regularly consult when applicable the ingredients list and allergy-related information displayed on the packaging of each product.

Your will be covered by our quality guarantee on every product which means that our products will be of satisfactory quality, fit for their purpose and match our description of them to you. If we provide a product that is not of satisfactory quality, you can reject it at the point of delivery or proceed as set out in our Cancellation, Return and Refund Policy.

You will be responsible for ensuring that the products are stored and used as per the applicable preservation and sanitary laws, regulations, practices, and standards. We take no liability for consumption of products in breach of any of such standards

We do not guarantee that data communication via the internet will be error-free and/or available at all times. We accept no liability in respect of the constant, uninterrupted availability of our Services, nor for technical and electronic faults during sales transaction, in particular for any delay in processing, acknowledging, or accepting orders.

Diet and Health Release

Because some of the information on our Services may relate to modifications to animal diet, you agree to use your good judgment and reasonable care, including seeking counsel from your animal healthcare providers, prior to making any changes to your animal’s diet or lifestyle. No information on our Services is intended as medical or healthcare information or advice. Please consult your animal’s healthcare professional(s) regarding all matters related to your animal’s diet and health, including without limitation herbal and nutritional products. You agree not to rely on any information on the Services to make health-related decisions.

All images are for illustration purposes only. Images may sometimes not reflect the exact product that will be available at any specific time.

Content and Functionalities

Our Services may allow you to post content, publish comments or photographs, and have other type of communications and interactions through our Services, including through our social media channels ("Your Content"). Other than personally identifiable information, which is covered under the Privacy Policy, Your Content will be considered non-confidential and non-proprietary.

In posting Your Content, you confirm that you are the owner or have consent form the owner to post Your Content, and that you will not submit material that:

  • is copyrighted, subject to privacy or publicity rights or otherwise subject to third party proprietary rights unless you are the owner of such rights or have permission from the owner to submit the material and to sublicense to us such rights;

  • is unlawful, obscene, harassing, defamatory, libelous, pornographic, hateful, racially or ethnically offensive or is otherwise inappropriate in accordance with the cultural and religious sensitivities of the UAE.

  • could damage the reputation of us or our Services or any third party; or

  • impersonates another person.

We reserve our right to remove any of Your Content at our sole discretion and without notice or liability to you or to any other person.

By submitting or uploading Your Content, you grant us a perpetual, worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display and perform Your Content for any purpose and you also irrevocably waive the benefit of any moral rights you may have therein.

All information or content transmitted by any functionality made available on or in respect of our Services, including online invitations, e-cards, email or send to a friend functionality are the responsibility of you, the sender. We cannot be held liable either directly or indirectly for your use of any such functionality, nor for any loss nor damage of any kind which you may incur as the result of the same. You agree to indemnify us and each member of the corporate group of companies for any such loss which may have occurred.

Certain links on our Service will lead to websites which are not under our control; similarly, you may have accessed our Services through a link made available on any such other websites. We have no control over and will not accept responsibility, or liability, for any material or service contained on any website which is not under our control nor does the existence of such links represent any endorsement or other acceptance of responsibility or liability by us for any products or services provided or available on such sites.

Marketing and Promotions

We may use data related to you to provide you with information about goods and services which may be of interest to you and enhance your experience when using our Services, such as service messages, new features, enhancements, special offers, events of interest, etc. We may contact you via various channels, including without limitation emails, SMS, push notifications, web/app notifications, post, telephone, instant electronic communication, in-app messages, news feed cards, among others.

We may launch promotions from time to time on our Services and you agree to abide by the terms that we set in connection with each specific promotion as further communicated to you and/or published on our Services.

Limitation of Liability

You agree that we will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages arising out of or in connection with your use of our Services or our products and other services.

You further agree we will not be liable for any damages arising from interruption, suspension or termination of any Services, including without limitation any direct, indirect, incidental, special, consequential or exemplary damages, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent. in no event shall our total aggregate liability to you for any losses arising hereunder exceed the amounts paid by you to us in connection with the single order giving raise to your claim.

We may modify or discontinue any or all Services at any time at our own discretion, or may modify, suspend or terminate your access to our Services or any support we may provide therein, for any reason, with or without notice to you and without liability to you or any third party.

We reserve our right to take appropriate legal action, including without limitation pursuing civil, criminal or injunctive redress. Even after your right to use our Services is terminated, your account or use will remain enforceable against you.

Governing Law and Dispute Resolution

Any dispute or claim arising out of or in connection with our Services (including with this website or application) shall be governed and construed in accordance with the laws of UAE as applicable to the Emirate of Abu Dhabi.

If any dispute arises between you and us in connection with the Services, you and us agree to first attempt to resolve it in an amicable manner by mutual negotiation. If the dispute cannot be amicably resolved, you and us agree to refer the same to for final resolution to the courts of the Abu Dhabi Global Market.

Miscellaneous

Assignment. Your obligations, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by us without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

Force Majeure. We shall not have any liability to you for any delay or non-performance of our Services, to the extent that such delay or non-performance is attributable to an Event of Force Majeure. For the purposes of this provision, "Event of Force Majeure" means an act of God, war, riot, rebellion or civil unrest, pandemic, labor dispute, or failure of facilities, networks, equipment or software, act of government or regulatory authority, or any similar event, to the extent that such event is beyond our reasonable control.

No Waiver. No waiver of any of these terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision shall not constitute a waiver of such right or provision.

Domicile. United Arab of Emirates is our country of domicile.
